EULA - End User License Agreement

License agreement for ContRay

Please note: This is a license agreement and not a contract of purchase! The software "ContRay" is made available to you according to this license agreement, which determines what you may do with the product and which defines warranty and compensation obligations.

License Agreement
Important: Please read the license agreement carefully. By buying, installing and using the software "ContRay" you state that you have read the license agreement and that you fully agree to it.

A. License Agreement
The vendor delivers the software ContRay, documentation and example files (together this is called 'product' or 'software' from now on) and allows to use it according to the license agreement. The Copyright and all rights concerning the product remain property of the developers of the product, who are not necessarily the vendors. The software ContRay consists of several scripts that allow to view the complete source code. You must reproduce the Copyright notes and all other notes concerning the product in each script you use and in each copy of it.

B. You may:
You may use the product on one computer or network and install it only once. You may create and maintain only one Internet presence at one time with the product, no matter how many copies of the product you possess. If you want to use the product for more than one Internet web site you will need a separate license for each web site. You can obtain a license for more than one person.

You may create one backup copy of the product.

You may transfer the license to somebody else, but only if you cede all rights deriving from the license agreement to this person, stop using the product and delete or destroy all copies of the product (including backup copies). The person to whom the license is transferred to must agree to this license agreement.

If the product is an upgrade of a different product you may use or transfer this product only with the original product.

You may extend the software and modify it to your needs, if you do this only for your own purposes and only for your individual license. Extensions and modifications (called 'MODs' from now on) may only be made available for others if the vendor permitted it. Selling the MODs is only allowed after consulting the vendor and the owners of the Copyright for ContRay. The creator of the MOD is liable for the risks of using it.

C. You may not:

You may not use or copy the product in a different way than specified in this license agreement.

You may not remove the copyright notes in the scripts and in the documentation.

You may not use the source code of the software in parts or whole of it for your own software. You may not imitate the principle of the software as a base for your own, similar software.

You may not lease, lend or transfer the product except according to the terms specified in this license agreement.

You may not add the product or parts of it to another product.

D. Term of Contract:

This license agreement is valid as long as you use the product. It becomes invalid if you infringe part of it. If you do so you agree to destroy all copies of the product immediately. The disclaimer remains valid.

E. Disclaimer:

THE SOFTWARE IS PROVIDED "AS IS" AND "WITH ALL FAULTS." THE VENDOR AND THE COPYRIGHT OWNERS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE QUALITY, SAFETY OR SUITABILITY OF THE SOFTWARE, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

THE VENDOR AND THE OWNERS OF THE COPYRIGHT MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE TRUTH, ACCURACY OR COMPLETENESS OF ANY STATEMENTS, INFORMATION OR MATERIALS CONCERNING THE SOFTWARE.

IN NO EVENT WILL THE VENDOR OR THE OWNERS OF THE COPYRIGHT BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES HOWEVER THEY MAY ARISE AND EVEN IF THEY HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

There are inherent dangers in the use of any software available for download on the Internet, and the vendor and the owners of the copyright caution you to make sure that you completely understand the potential risks before downloading any of the software. You are solely responsible for adequate protection and backup of the data and equipment used in connection with any of the software, and the vendor and the owner of the copyright will not be liable for any damages that you may suffer in connection with using, modifying or distributing any of the software.

F. Miscellaneous:
This license agreement is the sole agreement between the owners of the copyright, the vendor of the software and the buyer and licensee of the software. It replaces all other oral or written contracts or agreements and can only be modified by a written agreement. The license agreement was written under the laws of the Federal Republic of Germany. If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact. Venue is Landwehr, Germany.
